Introduction

These Terms of Service (“Terms”) govern your use of Whale Moves (“Whale Moves,” “we,” “our,” or “us”) and the services offered through our website Whale Moves (the “Site”). By purchasing or using any of our Products, you agree to be legally bound by these Terms. If you do not agree, you must refrain from using our Site and Services.

1. Legal Status and Ownership of Products

Whale Moves is operated as a de facto association and does not constitute a registered company. Activities carried out under the Whale Moves name take place within this associative and non-corporate framework. 

By purchasing and using our Products, you acknowledge and agree that Whale Moves is not a registered business entity and that its organizers and contributors provide the Products on an “as is” basis, without the guarantees or obligations that may apply to incorporated companies. 

As part of its activities, Whale Moves may make certain indicators or scripts available on an open-source, free-of-charge basis, intended for educational and community purposes. Whale Moves also develops and distributes other Products on a paid basis. The proceeds from these paid Products are used exclusively to support, maintain, and develop the initiative, its tools, and its community. Free Products are governed by the open-source license under which they are released. Paid Products remain the exclusive intellectual property of Whale Moves and are provided as closed-source scripts protected by password. Paid Products are licensed only for personal, limited, and non-transferable use, in accordance with these Terms. 

By accessing or acquiring any Whale Moves Product, whether free or paid, you acknowledge and agree to the applicable licensing terms.

2. Policy Documents

In addition to these Terms, your use of our Products is governed by our Privacy Policy and our Refund Policy. By accepting these Terms, you also acknowledge and agree to the provisions contained in those policies.

3. Age Compliance

You must be at least 18 years of age, or the age of majority in your jurisdiction, to purchase or use Whale Moves Products. By completing a purchase, you represent and warrant that you meet this age requirement. Whale Moves does not knowingly collect information from individuals under the age of 13, in compliance with the Children’s Online Privacy Protection Act (COPPA).

4. Unacceptable or Illegal Conduct

You agree that you will not use the Site or the Products for any unlawful or unauthorized purpose. Prohibited conduct includes, without limitation:

• infringing on any intellectual property, copyright, or trademark rights;

• engaging in fraudulent, deceptive, or illegal activity;

• attempting to share, resell, transfer, or otherwise distribute your Product license, password, or access credentials to another person.

Any violation of these restrictions may result in the immediate termination of your license without notice or refund, and may expose you to legal liability.

5. Website Fees & Payments

All applicable fees for Whale Moves Products are clearly displayed at the time of purchase. Payments are processed exclusively through Stripe, a secure third-party payment processor. Whale Moves does not process or store payment card details.

By completing a purchase, you agree to pay all fees as displayed at checkout and authorize Stripe to charge your selected payment method.

6. Refund Policy

All sales are final and non-refundable, except in cases where you did not receive access to the Product after purchase or where the Product was technically unusable and our support team could not resolve the issue.

7. Intellectual Property

All Products, including but not limited to scripts, software, designs, branding, and content made available on the Site, are the exclusive intellectual property of Whale Moves.

When you purchase a Product, you are granted a personal, limited, non-exclusive, non-transferable, revocable license to use the Product for your individual purposes. You may not copy, reproduce, distribute, resell, reverse-engineer, or otherwise exploit the Products or their passwords in any manner not expressly authorized by Whale Moves.

Unauthorized use of our intellectual property will result in the immediate termination of your license and may lead to legal proceedings.

8. Third-Party Links

The Site may reference or provide links to third-party websites, including but not limited to TradingView and Stripe. These third parties operate independently of Whale Moves and have their own terms of service and privacy policies. Whale Moves is not responsible for the content, policies, practices, or services of third-party websites. Your interactions with such third parties are solely between you and them.

9. Risk Disclosure

Trading financial instruments , including but not limited to stocks, futures, cryptocurrencies, and derivatives, involves substantial risk and is not suitable for every investor. You may incur significant financial losses, including the loss of your entire investment. 

By purchasing and using Whale Moves Products, you expressly acknowledge and agree that the Products are provided strictly for informational and educational purposes only, that Whale Moves does not provide investment, financial, or trading advice, and that no representation or warranty is made as to the accuracy, completeness, reliability, or profitability of the Products. Past performance does not guarantee future results, and you assume full and sole responsibility for your own trading activities. 

To the fullest extent permitted by law, Whale Moves, its organizers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to financial losses, arising out of or in connection with your use of the Products.

10. Change of Terms

We may update or modify these Terms from time to time at our sole discretion. Any changes will be posted with a new “Last Updated” date. Continued use of the Site or Products after such changes constitutes your acceptance of the revised Terms.

11. Termination of Privilege

Whale Moves reserves the right to suspend or terminate your access to the Products at any time, with or without notice, for any reason including but not limited to:

• violation of these Terms;

• unauthorized sharing or distribution of Product access;

• fraudulent or abusive behavior.

Upon termination, your license to use the Products will immediately cease, and no refunds will be provided.
